The lawsuit is being drafted by the city's Law Department and will be filed in the Circuit Court of Cook County, spokesman Bill McCaffrey said.

Last Thursday, the mayor had the city's Law Department send Smollett a letter titled "Re: Repayment of Investigation Costs for False Police Report", requiring "immediate payment of the $130,106.15 expended on overtime hours in the investigation of this matter". The black and openly gay actor claimed the two mask-clad men who attacked him hurled racist and homophobic insults, doused him with a chemical, and slipped a rope around his neck, which Smollett still had on when later interviewed by police.

But the city intends to file its suit in civil court, where a trial with jurors could decide whether Smollett orchestrated the attack.

A suit could lead to a drawn out battle in civil court that could end in a trial focused on the question of whether Smollett did or didn't orchestrate the January 29 attack.

Taraji P. Henson, who's starred alongside Jussie Smollett in "Empire", spoke on "The View" about his dropped charges surrounding an alleged attack police said he fabricated.

But, the leaders insisted, their issues with Foxx did not start with Smollett, who was accused of fabricating an possible hate crime against himself to bolster his profile and his career.
