Late Wednesday, as reports emerged that Craig would be charged, his lawyers said USA prosecutors in NY had looked at Craig's overseas work and "that office decided not to pursue charges".

If charged, Craig would be the first prominent Democrat to be caught in the dragnet cast by special counsel Robert Mueller into Russian Federation interference in the 2016 presidential campaign. An early Obama supporter, he served for a year as that president's first White House counsel.

On Wednesday night, Greg's attorneys told the Associated Press that the "government's stubborn insistence on prosecuting Mr. Craig is a misguided abuse of prosecutorial discretion".

In January, the firm paid $4.6 million and agreed to register as a lobbyist for a foreign government, as part of a Justice Department settlement.

USA prosecutors laid out how Craig, a top partner at Skadden Arps Slate Meagher & Flom, took pains to avoid registering his work as foreign lobbying - in part, they allege, out of a belief that registering under the so-called FARA law would prevent him and others from taking government jobs in the future.

The civil settlement with Skadden, Arps, Slate, Meagher & Flom LLP laid much of the blame for the firm's conduct on Craig, who was a senior partner.

Kellyanne Conway, a counselor to President Trump, reacted on social media: "FINALLY!"

Over the last few years, the Department of Justice has filed several charges involving the Foreign Agents Act.

Tymoshenko was a political opponent of then-Ukrainian President Viktor Yanukovych, who was a longtime Manafort patron. The firm wrote a report validating the Tymoshenko prosecution.

According to the indictment, Craig covered up aspects of his work in order to avoid registering as a foreign agent under the Foreign Agents Registration Act (FARA), a rarely enforced law that was enacted in 1938 to counter Nazi propaganda.

"Craig did not want to register as an agent for the government of Ukraine, however, least in part because he believed doing so could prevent him or others at the law firm from taking positions in the federal government in the future", court documents said.

Manafort also did lobbying work for the Ministry of Justice. The report was also presented to US government officials, raising questions if it constituted lobbying.

Craig's lawyers challenged claims that he had lied to the government and said that he had not participated in a public relations effort.

Yanukovych was one of the main lobbying clients of Manafort, who is now serving a 7 1/2-year prison sentence for lobbying violations and financial crimes. Last year, Alex van der Zwaan pleaded guilty to lying to the special counsel's office, admitting that he misled investigators about his discussions related to Skadden's work in preparing the report. He received 30 days in prison and was deported to the United Kingdom once his sentence was complete.

They also raised concerns that Craig's political affiliation had made him a target, and that he was being examined to compensate for an investigative emphasis on Trump-connected Republicans as a result of Mueller's probe. The case was investigated by the FBI's NY field office and is being prosecuted by the USA attorney's office in Washington, DC.
